Terms of Service

These Terms govern your use of OFS — Owner For Sale ("OFS", "we", "us"), the for-sale-by-owner property marketplace at ofsthai.com, operated as part of the WholeVoyage network. By using the site or listing a property, you agree to these Terms.

1. What OFS is

OFS is an advertising marketplace that lets property owners, developers and agents list residential and commercial property for sale in Thailand and connect directly with buyers. OFS is not a real-estate agent, broker, lawyer, or party to any sale. We do not value property, give legal or tax advice, hold funds in escrow, or guarantee any transaction. Any sale is solely between the seller and the buyer.

2. Listing fees

We charge flat advertising fees for listing plans — currently Free (฿0), Plus (฿3,500 / 6 months) and Premium (฿9,900 / 12 months), plus optional featured-listing upgrades. Fees are for the advertising service and are described on our Pricing page. We never charge a commission on a sale. Paid plans are billed once and are subject to our Refund & Cancellation Policy.

3. Your responsibilities as a lister

• You must have the right to advertise the property and the authority to do so.
• All information, prices and photos must be accurate, truthful and your own (or used with permission).
• You must keep listings current and remove or mark as sold when no longer available.
• You are responsible for complying with all applicable Thai property, advertising and tax laws.

4. Prohibited use

You may not post false, misleading, fraudulent, duplicate, or unlawful listings; infringe anyone's intellectual property; harvest other users' data; or use OFS to harass, spam, or defraud. We may review, edit, decline, suspend, or remove any listing or account at our discretion, and may refuse service.

5. Aggregated listings

Some listings are aggregated from public third-party sources and are clearly marked, showing only summary facts with a link back to the original source. OFS does not control and is not responsible for third-party listings or sites.

6. Content & licence

You keep ownership of the content you submit, and grant OFS a non-exclusive licence to host, display, resize, watermark and promote it across the OFS and WholeVoyage network for the purpose of advertising your listing.

7. Disclaimers & limitation of liability

The site and all listings are provided "as is", without warranty of any kind. OFS is not liable for the accuracy of listings, the conduct of any user, or the outcome of any transaction. To the maximum extent permitted by law, our total liability for any claim is limited to the fees you paid us in the previous 12 months. Always engage a qualified Thai property lawyer to verify title and handle any transfer.

8. Changes & governing law

We may update these Terms; continued use means you accept the changes. These Terms are governed by the laws of the Kingdom of Thailand.
